“Memlane”, “we” and “us” mean the provider of the Memlane app and service. “You” means the person who holds the account. By creating an account or using Memlane, you agree to these terms and to our Privacy Policy, which explains what we collect and what we do with it. If you do not agree, do not create an account.

You must be at least 13 years old to hold a Memlane account. If you are under the age of digital consent where you live, you may need a parent or guardian’s permission as well — that age is 13 in the United States and between 13 and 16 across the EU and UK.

Memlane is not designed for children and we do not knowingly collect data from anyone under 13. If you believe a child has an account, write to privacy@memlane.ai and we will delete it.

You keep everything you own. Your photos, journals, notes, and everything else you bring to Memlane remain yours. Nothing here transfers ownership of anything.

To actually run the service, you give us a limited licence to host, copy, process, analyse and display your content — solely to provide Memlane to you. That licence is:

• Non-exclusive — you can do whatever else you like with your own content.
• Worldwide and royalty-free, because servers and phones are in different countries and we are not paying you or charging you for the permission itself.
• Limited to operating Memlane for you. We do not use your content to advertise to you, sell to anyone, or train general-purpose AI models. See the Privacy Policy for exactly which processors touch what.
• Terminated when you delete. Deleting content, or your account, ends the licence for it, subject to the retention windows in the Privacy Policy.

If you share something out of Memlane — a trip story, a memory card — you are asking us to make that specific item viewable by whoever has the link, for as long as the share lives.

You are responsible for having the right to put content into Memlane in the first place. That matters most for photographs containing other people: Memlane analyses faces in your library, which is described in detail in the Privacy Policy. Where the law of your country requires the consent of the people in your photographs for that kind of processing, obtaining it is your responsibility, not ours.

Memlane is a private record of your own life. Do not use it to:

• Store or process another person’s data as a way of monitoring, tracking, profiling or investigating them. Memlane is for your memory, not for surveillance of someone else.
• Upload content you have no right to, or content that is unlawful where you or we are.
• Upload sexual content involving minors, or content that exists to harass or endanger someone. We report this where the law requires it.
• Break, probe, overload or circumvent the service — including automated scraping, reverse-engineering the API, evading rate limits or usage allowances, or sharing one account between several people.
• Resell Memlane, or use it to build a competing product from data we provide.

Memlane is not a medical device. It reads data from Apple Health if you let it, and it may show you patterns in that data, but nothing it says is a diagnosis or medical advice. It is likewise not financial, legal or professional advice. Talk to a professional for those.

The AI features can be wrong. They work from your own record, which is exactly why they are useful — and they can still misread it. Do not rely on Memlane as your only record of anything that matters.

Memlane’s memory layer is free and stays free. Paid tiers buy the AI layer.

Auto-renewal. Subscriptions are billed through your Apple ID. Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically for the same period at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period. You can manage and cancel subscriptions in your device’s Settings → your name → Subscriptions. Deleting the app does not cancel a subscription.

Free trial. New users get a 30-day free trial of Premium. If you buy a subscription during a free trial, the unused portion of the trial is forfeited. If you do not cancel before the trial ends, it converts to a paid subscription at the price shown when you signed up. If you cancel, you drop to Free — and you keep your archive.

Price changes. If we change the price of a plan you are on, we will tell you before it takes effect and you will have the chance to cancel. Under Apple’s rules some price increases require your explicit agreement before they apply.

Refunds are handled by Apple under the App Store’s terms, not by us — we cannot issue them directly. Contact Apple Support. Where consumer law in your country gives you a statutory right to a refund or to cancel, that right applies regardless of anything here.

Fair use. “Unlimited” on Premium means unlimited normal personal use. We apply a backstop against automated or abusive volume that no individual person could generate by hand. If you ever hit it, we will tell you rather than silently degrading your service.

BYOAI. On this tier your questions run against your own account with your AI provider, under your agreement with them. You are responsible for keeping that subscription active and for complying with that provider’s terms. If the link breaks or the provider changes what it permits, we may have to move you to another tier — we will tell you first and will not charge you for a tier you did not choose.

You can export everything at any time from Settings, and you can delete your account at any time. Deletion has a 30-day change-of-heart window, after which it is permanent and unrecoverable. The Privacy Policy is the detailed account of what we hold, for how long, and who else touches it.

You can stop at any time by cancelling your subscription, deleting your account, or simply not using Memlane.

We may suspend or end your account if you materially break these terms — most likely the acceptable-use section — or if we are legally required to, or if we discontinue Memlane entirely. Except where the law forbids it or where an account is being used to harm someone, we will give you notice and a reasonable chance to export your archive before we close it. If we discontinue Memlane, we will give you a meaningful period to get your data out and will refund the unused portion of any prepaid annual subscription.

Memlane is provided “as is”. We do not promise it will be uninterrupted, error-free, or that its AI will be accurate. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits. Our total liability to you for any claim arising out of or relating to Memlane is limited to the greater of the amount you paid us in the twelve months before the claim, or $100.

Nothing in this section limits liability that cannot lawfully be limited. That includes death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and — if you are a consumer — your statutory rights, which apply in full and are not affected by anything above.

Please keep your own copies of anything you cannot afford to lose. We take backups and we take them seriously, but no service should be your only copy of your life.

We will update these terms as Memlane changes. When a change is material, we will tell you in the app before it takes effect, and the date at the top of this page will change. Continuing to use Memlane after that means you accept the new terms; if you would rather not, you can cancel and export your archive.

We record which version of these terms your account was created under, so that “which terms did I agree to?” has a real answer. This version is 2026-08-30.

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Delaware have exclusive jurisdiction — except that if you are a consumer resident in the EU, the UK, or another jurisdiction whose law gives you the right to bring proceedings locally and to the protection of your own country’s mandatory consumer law, that right is unaffected and takes precedence over this paragraph.

If any part of these terms is held unenforceable, the rest stays in force. Our not enforcing something immediately does not mean we have given it up.
